1引 言
我(wo)國(guo)污(wu)(wu)染(ran)源(yuan)(yuan)監(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)工(gong)(gong)(gong)作(zuo)開(kai)始于20世紀70末期(qi),至(zhi)今已有三十多年(nian)的(de)(de)(de)歷程(cheng)。監(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)方式主要(yao)為(wei)(wei)各(ge)級環(huan)保部門(men)所屬環(huan)境監(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)站對轄區內(nei)各(ge)重點(dian)污(wu)(wu)染(ran)源(yuan)(yuan)進行一(yi)定頻次的(de)(de)(de)監(jian)(jian)(jian)(jian)(jian)(jian)督監(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce),監(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)結(jie)果(guo)主要(yao)用(yong)于環(huan)境執法和排(pai)(pai)污(wu)(wu)收(shou)費(fei),極少數大型企(qi)(qi)(qi)(qi)業(ye)(ye)也(ye)(ye)設(she)立有環(huan)境監(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)站,對企(qi)(qi)(qi)(qi)業(ye)(ye)自(zi)身的(de)(de)(de)排(pai)(pai)污(wu)(wu)狀(zhuang)況進行自(zi)行監(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)。污(wu)(wu)染(ran)源(yuan)(yuan)監(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)的(de)(de)(de)初期(qi),全國(guo)僅(jin)有3000家(jia)工(gong)(gong)(gong)業(ye)(ye)污(wu)(wu)染(ran)源(yuan)(yuan)列入到重點(dian)工(gong)(gong)(gong)業(ye)(ye)污(wu)(wu)染(ran)源(yuan)(yuan)普查范圍(wei),“十一(yi)五(wu)”期(qi)間(jian)(jian),為(wei)(wei)保證總量減(jian)排(pai)(pai)目(mu)標的(de)(de)(de)實現(xian),在(zai)國(guo)家(jia)減(jian)排(pai)(pai)專(zhuan)項資金(jin)支持(chi)下,將減(jian)排(pai)(pai)監(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)體系作(zuo)為(wei)(wei)主要(yao)污(wu)(wu)染(ran)物總量減(jian)排(pai)(pai)三大體系的(de)(de)(de)主要(yao)內(nei)容之(zhi)一(yi),污(wu)(wu)染(ran)源(yuan)(yuan)監(jian)(jian)(jian)(jian)(jian)(jian)督性監(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)得以(yi)全面(mian)開(kai)展,納(na)入國(guo)家(jia)重點(dian)監(jian)(jian)(jian)(jian)(jian)(jian)控(kong)企(qi)(qi)(qi)(qi)業(ye)(ye)的(de)(de)(de)數量從2008年(nian)的(de)(de)(de)近8000家(jia)增加至(zhi)2013年(nian)的(de)(de)(de)15797家(jia),企(qi)(qi)(qi)(qi)業(ye)(ye)類型包(bao)含了廢(fei)水國(guo)控(kong)企(qi)(qi)(qi)(qi)業(ye)(ye)、廢(fei)氣國(guo)控(kong)企(qi)(qi)(qi)(qi)業(ye)(ye)、污(wu)(wu)水處理廠、重金(jin)屬國(guo)控(kong)企(qi)(qi)(qi)(qi)業(ye)(ye)、規模(mo)化畜(chu)禽(qin)養殖場等五(wu)種類型,監(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)方式為(wei)(wei)手工(gong)(gong)(gong)監(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)和自(zi)動監(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)相(xiang)結(jie)合。與(yu)此同時,企(qi)(qi)(qi)(qi)業(ye)(ye)對排(pai)(pai)污(wu)(wu)狀(zhuang)況的(de)(de)(de)自(zi)行監(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)也(ye)(ye)得到了較(jiao)快發展,企(qi)(qi)(qi)(qi)業(ye)(ye)環(huan)境信息公開(kai)工(gong)(gong)(gong)作(zuo)穩步推進,如何(he)(he)規范引導企(qi)(qi)(qi)(qi)業(ye)(ye)自(zi)行監(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)工(gong)(gong)(gong)作(zuo),以(yi)及如何(he)(he)界(jie)定企(qi)(qi)(qi)(qi)業(ye)(ye)自(zi)行監(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)與(yu)環(huan)保部門(men)監(jian)(jian)(jian)(jian)(jian)(jian)督監(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)之(zhi)間(jian)(jian)的(de)(de)(de)關系等問題都需要(yao)盡快明確(que)。本(ben)文結合對我國(guo)(guo)企(qi)業(ye)(ye)排(pai)污狀(zhuang)況自行(xing)監測(ce)(ce)現狀(zhuang)調查,以及國(guo)(guo)外企(qi)業(ye)(ye)自行(xing)監測(ce)(ce)的發展,對我國(guo)(guo)企(qi)業(ye)(ye)自行(xing)監測(ce)(ce)的現狀(zhuang)、存在問題進行(xing)了深入分析(xi),為管理部門進一步推動并規范企(qi)業(ye)(ye)自行(xing)監測(ce)(ce)提出對策建議。
2我國企業自行監測現狀
2.1企業自行監測概念
企業(ye)自(zi)(zi)行監測,是指企業(ye)按照環(huan)境(jing)保(bao)護法(fa)律法(fa)規的(de)(de)要求,為了掌(zhang)握自(zi)(zi)身的(de)(de)排(pai)污狀(zhuang)況(kuang)、污染治理設施的(de)(de)運(yun)行狀(zhuang)況(kuang)、以(yi)及對企業(ye)周邊環(huan)境(jing)質量的(de)(de)影響狀(zhuang)況(kuang),自(zi)(zi)行組織開展的(de)(de)環(huan)境(jing)監測活動。分為自(zi)承擔監(jian)測(ce)(ce)和委托監(jian)測(ce)(ce),自(zi)承擔監(jian)測(ce)(ce)指企業依(yi)托自(zi)有人(ren)員、場所、設備,開(kai)展的(de)監(jian)測(ce)(ce)活動;委托監(jian)測(ce)(ce)指企業委托其他檢(監(jian))測(ce)(ce)機構,代(dai)其開(kai)展的(de)監(jian)測(ce)(ce)活動。
其中,污(wu)(wu)染(ran)物(wu)排放(fang)監(jian)(jian)測(ce),應對企業(ye)生產過(guo)程中產生的(de)(de)廢(fei)水(shui)(shui)污(wu)(wu)染(ran)物(wu)、廢(fei)氣污(wu)(wu)染(ran)物(wu)、廠界(jie)噪(zao)聲、固(gu)體廢(fei)物(wu)等(deng)開展(zhan)監(jian)(jian)測(ce),掌(zhang)握排污(wu)(wu)狀(zhuang)況(kuang);污(wu)(wu)染(ran)治(zhi)理設施(shi)(shi)的(de)(de)監(jian)(jian)測(ce),應分別對各廢(fei)水(shui)(shui)、廢(fei)氣治(zhi)理設施(shi)(shi)的(de)(de)進(jin)口和(he)出口開展(zhan)監(jian)(jian)測(ce),掌(zhang)握各種(zhong)污(wu)(wu)染(ran)治(zhi)理設施(shi)(shi)的(de)(de)運(yun)行狀(zhuang)況(kuang);周邊環(huan)境(jing)(jing)質(zhi)量影(ying)響的(de)(de)監(jian)(jian)測(ce),應對企業(ye)周邊的(de)(de)地表水(shui)(shui)、地下水(shui)(shui)、環(huan)境(jing)(jing)噪(zao)聲、環(huan)境(jing)(jing)空氣、土壤等(deng)定(ding)期開展(zhan)監(jian)(jian)測(ce),以掌(zhang)握自身生產排污(wu)(wu)是否對周邊環(huan)境(jing)(jing)造成(cheng)影(ying)響,以及影(ying)響的(de)(de)程度。
2.2我國企業自行監測總體情況
2012年,為了解國家重點監控企(qi)(qi)業污(wu)染源自行(xing)監測工作(zuo)現(xian)狀,環(huan)境保(bao)護部(bu)曾(ceng)對(dui)全(quan)國31個省、自治區(qu)、直轄市以及新疆(jiang)生產建設(she)兵團,開展了污(wu)染源自行(xing)監測能力(li)調查,調查范圍為環(huan)保(bao)部(bu)發布(bu)的《2012年國家重點監控企(qi)(qi)業名單》(環(huan)辦[2011]144號文)中的國控企(qi)(qi)業。參與調查的13352家企(qi)(qi)業中開展自行(xing)監測的有10285家,占67%,另(ling)有3067家國控企(qi)(qi)業尚未開展自行(xing)監測,占33%。
2.3 自行監測方式
開展(zhan)自(zi)行監(jian)(jian)(jian)測(ce)(ce)的(de)(de)(de)國控企業(ye)中(zhong),20%的(de)(de)(de)采(cai)(cai)用手工(gong)監(jian)(jian)(jian)測(ce)(ce),80%的(de)(de)(de)采(cai)(cai)用自(zi)動監(jian)(jian)(jian)測(ce)(ce),其(qi)(qi)中(zhong),采(cai)(cai)用手工(gong)監(jian)(jian)(jian)測(ce)(ce)方(fang)(fang)式(shi)的(de)(de)(de)企業(ye)中(zhong),70%的(de)(de)(de)企業(ye)為自(zi)承擔(dan)監(jian)(jian)(jian)測(ce)(ce),30%的(de)(de)(de)企業(ye)委(wei)托其(qi)(qi)他機(ji)構代為監(jian)(jian)(jian)測(ce)(ce);采(cai)(cai)用自(zi)動監(jian)(jian)(jian)測(ce)(ce)方(fang)(fang)式(shi)的(de)(de)(de)企業(ye)中(zhong),26%的(de)(de)(de)企業(ye)自(zi)行運(yun)(yun)營自(zi)動監(jian)(jian)(jian)測(ce)(ce)設備,74%的(de)(de)(de)企業(ye)由第三(san)方(fang)(fang)機(ji)構運(yun)(yun)營其(qi)(qi)自(zi)動監(jian)(jian)(jian)測(ce)(ce)設備。
2.4不同類別企業自行監測現狀
參與調查的企(qi)業(ye)中(zhong),廢水(shui)國控(kong)企(qi)業(ye)中(zhong)有(you)(you)70%的企(qi)業(ye)開(kai)展(zhan)了(le)(le)自行(xing)監(jian)測,廢氣國控(kong)企(qi)業(ye)中(zhong)有(you)(you)76%的企(qi)業(ye)開(kai)展(zhan)了(le)(le)自行(xing)監(jian)測,污水(shui)處理廠(chang)中(zhong)有(you)(you)96%的企(qi)業(ye)開(kai)展(zhan)了(le)(le)自行(xing)監(jian)測,重(zhong)金屬國控(kong)企(qi)業(ye)中(zhong)有(you)(you)32%的企(qi)業(ye)開(kai)展(zhan)了(le)(le)自行(xing)監(jian)測。
2.5不同區域企業自行監測現狀
除(chu)西(xi)藏未開(kai)展(zhan)自行(xing)監(jian)(jian)測外(wai),其余開(kai)展(zhan)自行(xing)監(jian)(jian)測的各地(di)區(qu)(qu)中,北(bei)(bei)京、天津、上(shang)海、江蘇、山東(dong)、貴州6個地(di)區(qu)(qu)企(qi)業(ye)自行(xing)監(jian)(jian)測開(kai)展(zhan)率在80%~100%之(zhi)間以(yi)上(shang),河北(bei)(bei)、山西(xi)、內蒙、遼寧、黑(hei)龍江、浙江、安徽、湖北(bei)(bei)、廣(guang)東(dong)、廣(guang)西(xi)、海南、重慶(qing)、四川(chuan)、甘(gan)肅、新(xin)疆、兵團16個地(di)區(qu)(qu)企(qi)業(ye)自行(xing)監(jian)(jian)測開(kai)展(zhan)率介(jie)于60%~80%,寧夏、青海、河南、江西(xi)、福建(jian)、云南、湖南、吉林(lin)、陜西(xi)9個地(di)區(qu)(qu)企(qi)業(ye)自行(xing)監(jian)(jian)測開(kai)展(zhan)率為60%以(yi)下。
從地(di)域(yu)上分(fen)析(xi),東、中、西部(bu)地(di)區企業自行監測開展率分(fen)別為72%、62%、64%。
2.6不同行業自行監測現狀
參與調查(cha)的(de)(de)15個主要(yao)行(xing)(xing)業(ye)中,紡織、化工行(xing)(xing)業(ye)開展自行(xing)(xing)監(jian)測(ce)的(de)(de)比例較高,占80%以上。金(jin)屬(shu)(shu)制品、有色(se)金(jin)屬(shu)(shu)冶(ye)煉及壓延加(jia)工、黑(hei)色(se)金(jin)屬(shu)(shu)冶(ye)煉及壓延加(jia)工、電力熱力的(de)(de)生產和供應行(xing)(xing)業(ye)開展自行(xing)(xing)監(jian)測(ce)的(de)(de)比例較低,占50%以下。
3國外企業自行監測開展情況
美國(guo)EPA環境與(yu)健康(kang)國(guo)際(ji)合(he)作科學(xue)小組(zu)1996年的一份報(bao)(bao)告(gao)(gao)《Environmental Compliance and Enforcement Capacity Building Resource Document International Comparison of Source Self-Monitoring,Reporting, and Recordkeeping Requirements》(污染源自行(xing)(xing)(xing)監(jian)測(ce)(ce)(ce)、報(bao)(bao)告(gao)(gao)與(yu)記(ji)錄(lu)保(bao)存要(yao)求的國(guo)家間比較(jiao)研究(jiu)報(bao)(bao)告(gao)(gao))中對美國(guo)、英國(guo)、加拿大(da)、德國(guo)、匈牙利、印度、墨西哥、荷(he)蘭等國(guo)污染源自行(xing)(xing)(xing)監(jian)測(ce)(ce)(ce)中監(jian)測(ce)(ce)(ce)參數確(que)定、監(jian)測(ce)(ce)(ce)方(fang)法(fa)(fa)、監(jian)測(ce)(ce)(ce)頻次、監(jian)測(ce)(ce)(ce)報(bao)(bao)告(gao)(gao)、質量(liang)保(bao)證(zheng)等要(yao)求進行(xing)(xing)(xing)了(le)詳細比較(jiao),總的來講,上述國(guo)家對自行(xing)(xing)(xing)監(jian)測(ce)(ce)(ce)工作的相關方(fang)面都做了(le)詳細的要(yao)求。該報(bao)(bao)告(gao)(gao)中指出自行(xing)(xing)(xing)監(jian)測(ce)(ce)(ce)方(fang)法(fa)(fa)可包(bao)括連續自動(dong)監(jian)測(ce)(ce)(ce)、通過(guo)煙道采樣后再進行(xing)(xing)(xing)物(wu)理或化學(xue)分析的間接監(jian)測(ce)(ce)(ce)、替代(dai)監(jian)測(ce)(ce)(ce)、視覺或嗅覺監(jian)測(ce)(ce)(ce)、物(wu)料平衡等。廢氣自行監測參數有:SO2、CO、NOx、VOCs、PM、金屬、可見度、HCl等。在監(jian)(jian)(jian)測(ce)(ce)(ce)(ce)頻(pin)次(ci)(ci)方面主要根(gen)據設備的種(zhong)類(lei)、企業規模、排(pai)放(fang)(fang)量等(deng)來確定。例(li)如在加拿(na)大(da),但污(wu)染(ran)物(wu)(wu)(wu)排(pai)放(fang)(fang)超出(chu)(chu)國家標準時(shi)會要求增(zeng)加監(jian)(jian)(jian)測(ce)(ce)(ce)(ce)頻(pin)次(ci)(ci),而(er)在一段時(shi)間內未檢(jian)出(chu)(chu)某(mou)種(zhong)污(wu)染(ran)物(wu)(wu)(wu)時(shi)可以(yi)(yi)(yi)降低監(jian)(jian)(jian)測(ce)(ce)(ce)(ce)頻(pin)次(ci)(ci),以(yi)(yi)(yi)造(zao)紙廠和(he)選(xuan)礦(kuang)廠為例(li),污(wu)染(ran)物(wu)(wu)(wu)的監(jian)(jian)(jian)測(ce)(ce)(ce)(ce)頻(pin)次(ci)(ci)從連(lian)續監(jian)(jian)(jian)測(ce)(ce)(ce)(ce)到每(mei)月監(jian)(jian)(jian)測(ce)(ce)(ce)(ce)不(bu)等(deng),如BOD的監(jian)(jian)(jian)測(ce)(ce)(ce)(ce)需(xu)(xu)要每(mei)周3次(ci)(ci),懸浮(fu)物(wu)(wu)(wu)則(ze)需(xu)(xu)要每(mei)天1次(ci)(ci),急性(xing)毒性(xing)實(shi)驗需(xu)(xu)要每(mei)周1次(ci)(ci),而(er)pH、流量、電導率需(xu)(xu)要連(lian)續監(jian)(jian)(jian)測(ce)(ce)(ce)(ce)等(deng)等(deng)。在監(jian)(jian)(jian)測(ce)(ce)(ce)(ce)方式(shi)上企業可以(yi)(yi)(yi)自己建立(li)實(shi)驗室(shi)開展(zhan)監(jian)(jian)(jian)測(ce)(ce)(ce)(ce),也可以(yi)(yi)(yi)委(wei)托(tuo)企業之(zhi)外的檢(jian)測(ce)(ce)(ce)(ce)機構開展(zhan)監(jian)(jian)(jian)測(ce)(ce)(ce)(ce)。
在自行監測報告(gao)方面歐美等國家將報告(gao)分為三種(zhong)情況:一是報告所有自行監測數據;二是報告與特定環境或發生事情相應的數據;三是不報告,只記錄。報(bao)(bao)告(gao)的頻次根據管理部門需要(yao)不同而設定,主要(yao)包括以下幾種情(qing)況(kuang):一是(shi)采用每(mei)年(nian)報(bao)(bao)告(gao)、或每(mei)一段固定時(shi)間報(bao)(bao)告(gao),二是(shi)超標(biao)時(shi)報(bao)(bao)告(gao);三是(shi)即時(shi)報(bao)(bao)告(gao),例如發生(sheng)事故時(shi)。
2007年世界經(jing)濟發展與合作組織(zhi)(zhi)的(de)(de)一份報告(gao)《technical guide on environmental self-monitoring in countries of eastern europe, caucasus, and central asia 》(東歐(ou)、高加索、中(zhong)亞(ya)地區環(huan)(huan)境(jing)自行(xing)(xing)監(jian)(jian)測(ce)技術導(dao)(dao)則(ze))中(zhong)提到(dao)在該(gai)(gai)組織(zhi)(zhi)部(bu)分(fen)(fen)成(cheng)員(yuan)國內企(qi)(qi)(qi)業(ye)(ye)(ye)自行(xing)(xing)監(jian)(jian)測(ce)工(gong)作有(you)著相當(dang)長的(de)(de)歷史,部(bu)分(fen)(fen)大型企(qi)(qi)(qi)業(ye)(ye)(ye)在20世紀70年代中(zhong)期就(jiu)已經(jing)建立(li)了(le)(le)自行(xing)(xing)監(jian)(jian)測(ce)制(zhi)度,該(gai)(gai)導(dao)(dao)則(ze)對(dui)其成(cheng)員(yuan)國內的(de)(de)企(qi)(qi)(qi)業(ye)(ye)(ye)自行(xing)(xing)監(jian)(jian)測(ce)工(gong)作提出了(le)(le)指導(dao)(dao)性意見,認為要(yao)求企(qi)(qi)(qi)業(ye)(ye)(ye)開展自行(xing)(xing)監(jian)(jian)測(ce)并報告(gao)是促使企(qi)(qi)(qi)業(ye)(ye)(ye)履行(xing)(xing)環(huan)(huan)境(jing)責(ze)(ze)(ze)任的(de)(de)重要(yao)方(fang)式,并能夠使有(you)限的(de)(de)政府監(jian)(jian)管資(zi)源得(de)到(dao)合理配置,并促進(jin)環(huan)(huan)境(jing)信息公開。該(gai)(gai)導(dao)(dao)則(ze)指出企(qi)(qi)(qi)業(ye)(ye)(ye)應(ying)當(dang)制(zhi)訂自行(xing)(xing)監(jian)(jian)測(ce)草案(an),環(huan)(huan)境(jing)主管部(bu)門在適當(dang)的(de)(de)時候應(ying)該(gai)(gai)審查此(ci)方(fang)案(an),可以接受或(huo)否(fou)決此(ci)方(fang)案(an)或(huo)要(yao)求該(gai)(gai)方(fang)案(an)進(jin)行(xing)(xing)修訂。企(qi)(qi)(qi)業(ye)(ye)(ye)必(bi)須(xu)保證(zheng)必(bi)要(yao)的(de)(de)技術力量、監(jian)(jian)測(ce)設備來保證(zheng)監(jian)(jian)測(ce)方(fang)案(an)所要(yao)求的(de)(de)自行(xing)(xing)監(jian)(jian)測(ce)活動,也可以由企(qi)(qi)(qi)業(ye)(ye)(ye)負責(ze)(ze)(ze)采樣,外(wai)部(bu)的(de)(de)實(shi)驗室負責(ze)(ze)(ze)分(fen)(fen)析樣品,在東歐(ou)、高加索、中(zhong)亞(ya)等地區,企(qi)(qi)(qi)業(ye)(ye)(ye)委托外(wai)部(bu)機構進(jin)行(xing)(xing)監(jian)(jian)測(ce)或(huo)者選擇一個企(qi)(qi)(qi)業(ye)(ye)(ye)的(de)(de)監(jian)(jian)測(ce)實(shi)驗室承(cheng)擔周邊幾(ji)個企(qi)(qi)(qi)業(ye)(ye)(ye)的(de)(de)自行(xing)(xing)監(jian)(jian)測(ce)是比較合適的(de)(de)一個方(fang)案(an)。
關(guan)于(yu)自(zi)行監測(ce)(ce)的(de)類型,該導則指出自(zi)行監測(ce)(ce)主要(yao)包(bao)括過程監測(ce)(ce)、排放監測(ce)(ce)、影(ying)響監測(ce)(ce),其中過程監測(ce)(ce)的(de)方案可有企業(ye)自(zi)行決定,排放監測(ce)(ce)和影(ying)響監測(ce)(ce)方案由環境主管(guan)部門(men)決定,關(guan)于(yu)影(ying)響監測(ce)(ce),并不要(yao)求所有企業(ye)都開(kai)展(zhan)影(ying)響監測(ce)(ce),而(er)由環境主管(guan)部門(men)根(gen)據具(ju)體情況(kuang)來確定是否需要(yao)開(kai)展(zhan)影(ying)響監測(ce)(ce)。
4我國企業自行監測工作面臨的主要問題
4.1 全社會對自行監測的重要性認識不夠
由于我(wo)國長(chang)期以來的環(huan)境管理,主(zhu)要(yao)(yao)以行(xing)(xing)政(zheng)管理為主(zhu),不注(zhu)重發揮(hui)公眾(zhong)、企(qi)(qi)業(ye)(ye)的作用,再加(jia)上相關法規不健全,因此對(dui)于污染源的監測,企(qi)(qi)業(ye)(ye)自(zi)身、社會公眾(zhong)、甚至一些(xie)環(huan)保執(zhi)法人(ren)員往(wang)往(wang)理解為主(zhu)要(yao)(yao)是政(zheng)府針對(dui)企(qi)(qi)業(ye)(ye)的監督監測,卻忽視了企(qi)(qi)業(ye)(ye)自(zi)身的環(huan)境保護責任和義務(wu),對(dui)企(qi)(qi)業(ye)(ye)自(zi)行(xing)(xing)監測重要(yao)(yao)性認識不足,甚至認為可有(you)可無,這種觀念嚴重影響(xiang)自(zi)行(xing)(xing)監測工作進展,亟(ji)需得到根(gen)本的扭轉(zhuan)。
4.2自行監測工作相關法律法規不健全
目(mu)前,在法(fa)(fa)律層(ceng)面僅有《中華人民(min)共和國水(shui)(shui)污染防治(zhi)法(fa)(fa)》規定(ding)(ding)廢水(shui)(shui)排放(fang)企業(ye)應(ying)當(dang)開展自行監(jian)測,但該法(fa)(fa)只適合于廢水(shui)(shui)排放(fang)企業(ye),對(dui)于廢氣排放(fang)企業(ye)、固體廢物排放(fang)企業(ye)目(mu)前并沒有相關法(fa)(fa)律規定(ding)(ding)。
雖然我國《排(pai)放污染(ran)物申報登(deng)記(ji)管(guan)理(li)規(gui)(gui)定(ding)》、《環(huan)境監(jian)(jian)(jian)測(ce)(ce)管(guan)理(li)辦法(fa)》等(deng)環(huan)保規(gui)(gui)章中有(you)也要(yao)求(qiu)企業對自身排(pai)污狀況(kuang)開(kai)展(zhan)監(jian)(jian)(jian)測(ce)(ce),但分散在(zai)不同(tong)的法(fa)律規(gui)(gui)定(ding)中,且規(gui)(gui)定(ding)內容過于籠統,往(wang)往(wang)是僅提出要(yao)開(kai)展(zhan)自行(xing)監(jian)(jian)(jian)測(ce)(ce),但如何確定(ding)監(jian)(jian)(jian)測(ce)(ce)項目、監(jian)(jian)(jian)測(ce)(ce)頻次、監(jian)(jian)(jian)測(ce)(ce)方法(fa)都沒有(you)規(gui)(gui)定(ding),缺乏(fa)可操作性,更重要(yao)的是對于違規(gui)(gui)的責任沒有(you)明確,環(huan)保部門也從(cong)未開(kai)展(zhan)過執法(fa)檢查,導(dao)致(zhi)自行(xing)監(jian)(jian)(jian)測(ce)(ce)工作進展(zhan)緩慢(man)。
4.3企業自行監測工作不規范
在我國已開展自行監(jian)(jian)測(ce)(ce)(ce)的企業(ye)中,大(da)部分(fen)企業(ye)開展自行監(jian)(jian)測(ce)(ce)(ce)工作存在不(bu)規范(fan)現(xian)象,譬如監(jian)(jian)測(ce)(ce)(ce)人員不(bu)專業(ye)、監(jian)(jian)測(ce)(ce)(ce)分(fen)析(xi)方(fang)法不(bu)統一、監(jian)(jian)測(ce)(ce)(ce)儀器未校(xiao)準、監(jian)(jian)測(ce)(ce)(ce)頻(pin)次隨意性強、監(jian)(jian)測(ce)(ce)(ce)結果發布(bu)不(bu)及時等現(xian)象。
4.4企業自行監測工作積極性不高
企業開展(zhan)自(zi)行(xing)(xing)監測(ce)工(gong)作(zuo)(zuo),需要配置相關(guan)的人員、耗材、儀器設備和監測(ce)場所,這樣就要耗費一定的人力、物(wu)力和財力,由于不能為(wei)企業帶來經濟效益,企業往(wang)往(wang)從經濟利益角度(du)出發,不愿意(yi)開展(zhan)自(zi)行(xing)(xing)監測(ce),或者(zhe)不愿意(yi)在自(zi)行(xing)(xing)監測(ce)工(gong)作(zuo)(zuo)中投入過多資金,開展(zhan)自(zi)行(xing)(xing)監測(ce)工(gong)作(zuo)(zuo)積極性(xing)不高,嚴(yan)重影響自(zi)行(xing)(xing)監測(ce)效果。
4.5自行監測面臨一些客觀困難
目前(qian),企(qi)(qi)業(ye)開展自行監(jian)測(ce)(ce)(ce)工作的(de)確(que)存在(zai)一定的(de)客(ke)觀困難。在(zai)監(jian)測(ce)(ce)(ce)人員(yuan)方面,企(qi)(qi)業(ye)普(pu)遍缺乏監(jian)測(ce)(ce)(ce)技術人員(yuan),由于監(jian)測(ce)(ce)(ce)工作對人員(yuan)素質要求較高,而在(zai)企(qi)(qi)業(ye)內(nei)部監(jian)測(ce)(ce)(ce)崗位因不(bu)(bu)能創(chuang)造效(xiao)益,待遇往(wang)往(wang)處于較低水平,因此很(hen)難聘(pin)請到(dao)合適的(de)人員(yuan),不(bu)(bu)利于自行監(jian)測(ce)(ce)(ce)工作的(de)健康發展。而在(zai)監(jian)測(ce)(ce)(ce)技術方面,缺乏專業(ye)的(de)技術指導(dao)和技術培訓,使(shi)得監(jian)測(ce)(ce)(ce)技術參(can)差(cha)不(bu)(bu)齊。
在委托(tuo)其他監(jian)測(ce)機(ji)構代(dai)為(wei)監(jian)測(ce)方面(mian)同樣(yang)存在一(yi)定困難。一(yi)方面(mian),委托(tuo)監(jian)測(ce)的費用很高,許多企(qi)業(ye)難以承受。另一(yi)方面(mian),許多地(di)區環(huan)保部(bu)門(men)所(suo)屬的監(jian)測(ce)部(bu)門(men)以外的社會化監(jian)測(ce)市場尚不成熟,有的地(di)區甚至(zhi)連一(yi)家(jia)社會化的檢測(ce)機(ji)構都沒有。環(huan)保部(bu)門(men)所(suo)屬監(jian)測(ce)站近年來政府指(zhi)令性監(jian)測(ce)任務日益(yi)繁重,根(gen)本無暇(xia)顧(gu)及企(qi)業(ye)的委托(tuo)監(jian)測(ce),當(dang)企(qi)業(ye)自(zi)身不具備(bei)監(jian)測(ce)能力想委托(tuo)其他機(ji)構代(dai)為(wei)監(jian)測(ce)時,找不到可以委托(tuo)的監(jian)測(ce)機(ji)構。
5.規范企業自行監測的對策建議
5.1推進社會對企業自行監測工作的認識
企(qi)(qi)(qi)業(ye)(ye)(ye)生產是(shi)造(zao)成(cheng)環境(jing)污染最(zui)主(zhu)(zhu)(zhu)要(yao)的(de)原(yuan)因(yin)之(zhi)一(yi),企(qi)(qi)(qi)業(ye)(ye)(ye)自(zi)然應(ying)該成(cheng)為改善環境(jing)的(de)主(zhu)(zhu)(zhu)力軍,充分發揮企(qi)(qi)(qi)業(ye)(ye)(ye)在(zai)(zai)環境(jing)保護工(gong)(gong)作(zuo)(zuo)的(de)主(zhu)(zhu)(zhu)觀能(neng)動(dong)作(zuo)(zuo)用(yong)(yong),同(tong)時這(zhe)也是(shi)企(qi)(qi)(qi)業(ye)(ye)(ye)必(bi)(bi)須履(lv)行(xing)的(de)法(fa)(fa)定義務。在(zai)(zai)污染源信息公開方面同(tong)樣需要(yao)充分發揮企(qi)(qi)(qi)業(ye)(ye)(ye)自(zi)身作(zuo)(zuo)用(yong)(yong),大(da)力推(tui)行(xing)自(zi)行(xing)監(jian)(jian)測(ce)(ce),以充分保證公眾的(de)環境(jing)知情權(quan)。我國《排(pai)放污染物(wu)申報(bao)登記管理規(gui)定》、《中華人民共和國水(shui)污染防治法(fa)(fa)》、《環境(jing)監(jian)(jian)測(ce)(ce)管理辦(ban)法(fa)(fa)》都要(yao)求企(qi)(qi)(qi)業(ye)(ye)(ye)開展自(zi)行(xing)監(jian)(jian)測(ce)(ce),因(yin)此(ci)開展自(zi)行(xing)監(jian)(jian)測(ce)(ce)也是(shi)企(qi)(qi)(qi)業(ye)(ye)(ye)必(bi)(bi)須履(lv)行(xing)的(de)法(fa)(fa)定義務。我們必(bi)(bi)須通過不斷宣(xuan)傳,推(tui)進全社會對(dui)企(qi)(qi)(qi)業(ye)(ye)(ye)自(zi)行(xing)監(jian)(jian)測(ce)(ce)工(gong)(gong)作(zuo)(zuo)的(de)認(ren)識,環保部(bu)門要(yao)加強對(dui)企(qi)(qi)(qi)業(ye)(ye)(ye)自(zi)行(xing)監(jian)(jian)測(ce)(ce)工(gong)(gong)作(zuo)(zuo)的(de)指導(dao)和管理,推(tui)動(dong)企(qi)(qi)(qi)業(ye)(ye)(ye)自(zi)覺履(lv)行(xing)自(zi)行(xing)監(jian)(jian)測(ce)(ce)職(zhi)責,改變環境(jing)保護由政府部(bu)門單(dan)向主(zhu)(zhu)(zhu)導(dao)的(de)局面,充分發揮企(qi)(qi)(qi)業(ye)(ye)(ye)在(zai)(zai)污染源監(jian)(jian)測(ce)(ce)工(gong)(gong)作(zuo)(zuo)的(de)主(zhu)(zhu)(zhu)觀能(neng)動(dong)作(zuo)(zuo)用(yong)(yong)。
5.2加快修訂完善相關法律法規
企業不僅(jin)對廢水(shui)排(pai)放情(qing)況(kuang)開(kai)(kai)展自(zi)行(xing)(xing)監(jian)(jian)(jian)測(ce)(ce)(ce)(ce),對廢氣、固廢、噪聲等其他要素的(de)排(pai)放情(qing)況(kuang)同樣需要開(kai)(kai)展自(zi)行(xing)(xing)監(jian)(jian)(jian)測(ce)(ce)(ce)(ce),但對于企業自(zi)行(xing)(xing)監(jian)(jian)(jian)測(ce)(ce)(ce)(ce)的(de)法(fa)(fa)律(lv)規(gui)定,僅(jin)存在(zai)于《中(zhong)(zhong)華(hua)人(ren)(ren)民共和(he)國(guo)水(shui)污(wu)(wu)染(ran)防(fang)(fang)治法(fa)(fa)》中(zhong)(zhong),建議管理(li)部門加快修訂完(wan)善我(wo)國(guo)現行(xing)(xing)的(de)環(huan)境保(bao)護(hu)法(fa)(fa)律(lv)法(fa)(fa)規(gui),在(zai)《中(zhong)(zhong)華(hua)人(ren)(ren)民共和(he)國(guo)環(huan)境保(bao)護(hu)法(fa)(fa)》、《中(zhong)(zhong)華(hua)人(ren)(ren)民共和(he)國(guo)大(da)氣污(wu)(wu)染(ran)防(fang)(fang)治法(fa)(fa)》、《中(zhong)(zhong)華(hua)人(ren)(ren)民共和(he)國(guo)固體(ti)廢物污(wu)(wu)染(ran)環(huan)境防(fang)(fang)治法(fa)(fa)》、《中(zhong)(zhong)華(hua)人(ren)(ren)民共和(he)國(guo)噪聲污(wu)(wu)染(ran)防(fang)(fang)治法(fa)(fa)》等相關的(de)環(huan)境保(bao)護(hu)法(fa)(fa)律(lv)法(fa)(fa)規(gui)修訂過程中(zhong)(zhong)增加自(zi)行(xing)(xing)監(jian)(jian)(jian)測(ce)(ce)(ce)(ce)的(de)相關內容,從(cong)法(fa)(fa)律(lv)上明確自(zi)行(xing)(xing)監(jian)(jian)(jian)測(ce)(ce)(ce)(ce)工作的(de)責任(ren)主體(ti)和(he)義務(wu),同時(shi)加快《國(guo)家重點監(jian)(jian)(jian)控企業自(zi)行(xing)(xing)監(jian)(jian)(jian)測(ce)(ce)(ce)(ce)及信(xin)息公開(kai)(kai)辦法(fa)(fa)》的(de)出(chu)臺,使企業全(quan)面開(kai)(kai)展各要素的(de)自(zi)行(xing)(xing)監(jian)(jian)(jian)測(ce)(ce)(ce)(ce)均有法(fa)(fa)可依。
5.3培育社會化檢測市場,規范社會檢測行為
針對我(wo)國自(zi)(zi)行(xing)(xing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)工(gong)(gong)作(zuo)(zuo)(zuo)開展(zhan)情況,以及自(zi)(zi)行(xing)(xing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)工(gong)(gong)作(zuo)(zuo)(zuo)面(mian)(mian)臨(lin)的(de)(de)主(zhu)要(yao)(yao)問題,在(zai)(zai)(zai)(zai)今(jin)后一段時(shi)(shi)期內,社(she)會化(hua)檢(jian)測(ce)(ce)(ce)(ce)機(ji)構(gou)(gou)在(zai)(zai)(zai)(zai)自(zi)(zi)行(xing)(xing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)工(gong)(gong)作(zuo)(zuo)(zuo)中將發揮(hui)重(zhong)要(yao)(yao)作(zuo)(zuo)(zuo)用(yong)。一方(fang)面(mian)(mian)由于環(huan)(huan)境監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)工(gong)(gong)作(zuo)(zuo)(zuo)是(shi)一項(xiang)專(zhuan)業(ye)(ye)(ye)性很強的(de)(de)技術工(gong)(gong)作(zuo)(zuo)(zuo),除少(shao)數(shu)企業(ye)(ye)(ye)外,大(da)部(bu)分(fen)(fen)企業(ye)(ye)(ye)都不具(ju)備專(zhuan)業(ye)(ye)(ye)設(she)備和專(zhuan)業(ye)(ye)(ye)技術人員,為了開展(zhan)自(zi)(zi)行(xing)(xing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)必須采取委(wei)托監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)的(de)(de)方(fang)式,同時(shi)(shi)當今(jin)社(she)會化(hua)分(fen)(fen)工(gong)(gong)越來越細(xi),一個地(di)區(qu)在(zai)(zai)(zai)(zai)存在(zai)(zai)(zai)(zai)專(zhuan)業(ye)(ye)(ye)化(hua)檢(jian)測(ce)(ce)(ce)(ce)機(ji)構(gou)(gou)的(de)(de)情況下(xia),并不需要(yao)(yao)所有(you)(you)企業(ye)(ye)(ye)都建(jian)立自(zi)(zi)己的(de)(de)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)機(ji)構(gou)(gou)來開展(zhan)自(zi)(zi)行(xing)(xing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce),由專(zhuan)業(ye)(ye)(ye)機(ji)構(gou)(gou)開展(zhan)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce),有(you)(you)利于節約社(she)會資源;另一方(fang)面(mian)(mian)環(huan)(huan)保部(bu)門所屬的(de)(de)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)機(ji)構(gou)(gou)都面(mian)(mian)臨(lin)著繁(fan)重(zhong)的(de)(de)政府指令(ling)性監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)任務,沒有(you)(you)精力承擔過多(duo)的(de)(de)企業(ye)(ye)(ye)委(wei)托監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce),在(zai)(zai)(zai)(zai)此情況下(xia)部(bu)分(fen)(fen)地(di)區(qu)的(de)(de)專(zhuan)業(ye)(ye)(ye)化(hua)社(she)會檢(jian)測(ce)(ce)(ce)(ce)機(ji)構(gou)(gou)應運而生,可以預見,社(she)會化(hua)檢(jian)測(ce)(ce)(ce)(ce)機(ji)構(gou)(gou)將在(zai)(zai)(zai)(zai)企業(ye)(ye)(ye)自(zi)(zi)行(xing)(xing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)工(gong)(gong)作(zuo)(zuo)(zuo)中發揮(hui)重(zhong)要(yao)(yao)作(zuo)(zuo)(zuo)用(yong)。因此,在(zai)(zai)(zai)(zai)目前許多(duo)地(di)區(qu)尚缺少(shao)社(she)會化(hua)檢(jian)測(ce)(ce)(ce)(ce)機(ji)構(gou)(gou)的(de)(de)情況下(xia),建(jian)議相關部(bu)門盡快出臺(tai)相關配(pei)套法規(gui)(gui),大(da)力培育社(she)會化(hua)檢(jian)測(ce)(ce)(ce)(ce)市場,規(gui)(gui)范社(she)會檢(jian)測(ce)(ce)(ce)(ce)行(xing)(xing)為,使社(she)會檢(jian)測(ce)(ce)(ce)(ce)機(ji)構(gou)(gou)更加規(gui)(gui)范有(you)(you)序的(de)(de)涉入企業(ye)(ye)(ye)自(zi)(zi)行(xing)(xing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)工(gong)(gong)作(zuo)(zuo)(zuo)之中,確(que)保企業(ye)(ye)(ye)自(zi)(zi)行(xing)(xing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)工(gong)(gong)作(zuo)(zuo)(zuo)順(shun)利開展(zhan)。
5.4加強對企業自行監測工作的管理和指導
